I'm very happy to provide you with an update on how things have gone after one year from our conversation.
I got approved for my entrepreneur visa last year in September after applying in July and returned to Australia. Soon after, I was asked to host a show on cloud technology and have since produced over 80 one-hour episodes for the world's first business advisory app.
A few months later I was approached by a multinational accounting firm that wanted to set up a technology arm for their business and found me after watching the videos. In regards to my wife and children, I had made eleven visa applications over a four year period: three visitor visas, two medical visas, one no further stay waiver, one spouse visa, two child visas and two Bridging Visa B applications.
My now wife and I became aware of her life-threatening medical condition a month after her arrival on a visitor visa. While she was being treated here in Australia, her three children were in the Philippines. Their village was destroyed by Typhoon Yolanda and the seven-metre tsunami created by the typhoon. My wife lost the grandmother who raised her and was caring for the children. She also lost her youngest son, aged three. The remaining two children survived miraculously and in dire circumstances.
In dealing with all of this, I had become very familiar with immigration matters and had closely read major parts of the Australian Migration Act. Through my wife attending informal English classes at church, she became close friends with another Filipino woman, Reynalyn Iglesias. Reynalyn provided much support to my wife during the loss of her grandmother and son, and during the separation from her surviving children. We could not return to the Philippines because of my wife’s treatment and illness. (My wife has now fully recovered and the children are in Australia.)
Over time, I became aware that Reynalyn was suffering her own issues at home. I made enquiries and sought advice about what Reynalyn could do. I told her we would support her and her young daughter Jessica if she needed to remove herself from her situation. Shortly after, Reynalyn approached me to accept that support.
Apart from arranging practical support for Reynalyn and Jessica, the issue of their visa status was a major problem. She had been advised that she and Jessica were to be deported, subject to immigration processes. As Reynalyn had no money, I helped her obtain advice from several different migration agents, lawyers and support services. I began preparing a detailed outline of her story and commenced a ministerial appeal process as advised.
All the advice we received was pessimistic, and based on my own experience and reading of the law, I felt the same. I thought only a miracle would save Reynalyn and Jessica from their desperate situation.
Reynalyn’s English teacher at church, Gaye Doran, learned of her circumstances. Gaye made enquiries with her son-in-law, a lawyer, who recommended Joanne Kinslor.
I was hopeful but still privately pessimistic. Gaye arranged an appointment. By that time, I had written a substantial background outline for a ministerial intervention application.
At the first appointment, Joanne asked questions, took notes, read parts of the outline, spoke to Reynalyn privately, and advised a completely different course of action, something no other representative had proposed and something I had never encountered in all my experience with immigration matters and my study of the Australian Migration Act. Joanne referred to a very similar case she knew had been successful and identified all the proof required.
Joanne Kinslor and David Brooks (assisting) understood the urgency of the situation. They formulated immediate steps to take and accommodated this urgency with their actions. They also quickly understood and accommodated Reynalyn’s limited English, legal understanding, and her feelings of shame and anxiety.
Joanne asked us to return for a second appointment so she could review the case in more detail and for us to provide further information. For that appointment, I had prepared a list of questions on Reynalyn’s behalf, but Joanne answered every question within her explanation of the way forward before I even needed to ask.
It became obvious very quickly that Joanne Kinslor and her colleagues are at the top of their field. Immigration is an extremely difficult area of law, given government policy, constant change, cultural and language challenges faced by applicants, and the significant difficulties I had personally experienced in dealing with the Immigration Department.

There were three stages to Reynalyn’s case:
Appeal to the Federal Circuit Court
Referral back to the Administrative Appeals Tribunal (AAT – Migration Division)
Referral back to the Australian Immigration Department

Joanne’s representations to the Federal Circuit Court, arguing that the Immigration Department had made a decision based on circumstances at the time of lodgement rather than the time of decision, were accepted. The matter was referred back to the AAT. The AAT amended the previous decision based solely on Joanne’s written submissions and referred the matter back to the Immigration Department, noting the need to assess the current circumstances. This was successful, and the Department granted a permanent partner visa around August 2017.
I expected the process to take at least three years and involve many complications. Instead, Joanne was correct at every moment and achieved success in less than twelve months.
Joanne Kinslor’s efforts, skill, patience and knowledge have given Reynalyn and Jessica a life and opportunities they could not otherwise have had. If deported, their future would most likely have been poverty, destitution and hardship. I know this personally from my wife’s background in a remote village in the Philippines.
